Brian Way, a 43-year old Torontonian who has been in orison awaiting trial for nearly four year, has made international headlines as the purveyor of online videos that have triggered hundreds of charges against his customers worldwide. His case is now bringing a new definition to a legal gray are to Canada, what distinguishes child pornography from the artistic expression of "naturist" involving nude children. Brian has already pleaded guilty to seven pornography charges related to his personal collection of tens and thousands of images and videos that the police depicted explicit child sexual exploitation. At stake now is the outcome of the Crown’s central case: Sixteen charges of possessing, publishing and selling videos on a website called Azovfilms.com featuring naked prepubescent and pubescent boys. Brian has pleaded not guilty to those charges, alleging that the 176 films contains no explicit sexual content, and the boys were never aroused in any way. The star views some of the films sold on Azovfilm.com, and the films included inmates of young boys in the nude, wrestling, posing provocatively and acting out scenarios that included close-up shots of their genitals. If a man like this is released it is obvious that he is going to continue to film these boys, and shouldn't Canada do something about this gray area about showing peoples genitals and other explicit scenes, which if you think about it is basically porn. Should Brian Way still be getting away with filming boys, and calling "art" or should he be sent to jail for basically making child pornography, selling child pornography, and still trying to get away with it.
